MMSD Proposed Chapter 11 Rules, Discharge Regulations and Enforcement Procedures: Notice of Public Hearing and Comment Period

The Milwaukee Metropolitan Sewerage District (MMSD) proposes to update the Chapter 11 rules to promote the best results from construction, operation, and maintenance of the sewerage system, and promote pollution prevention and waste minimization for the region we serve.   

MMSD remains committed to meeting all federal, state, and local requirements designed to protect public health, water quality, and our wastewater infrastructure. The summary of the proposed Chapter 11 Rule changes:

  • Removal of requirements now in the Federal Register  
  • Creation of a formal application process for permits and sampling waivers  
  • Clarification of reporting requirements  
  • Expansion of enforcement procedures  
  • Inclusion of federal streamlining requirements  
  • Application of the total organic compound limit  
  • Correction of references and formatting

Public Hearing Notice

The MMSD Chapter 11 public hearing notice was published on December 21, 2026. The public hearing will be held at MMSD headquarters (260 W Seeboth St - Milwaukee, WI 53204) on January 21, 2026, at 2 pm.

Public Comment Period

MMSD seeks comments regarding the proposed amendments to the MMSD Rules, Chapter 11, Discharge Regulations and Enforcement Procedures. The Chapter 11 public comment period is from December 21 to January 21, 2026. Please note that all comments are a public record.

To share your feedback during the comment period:

  • Email comments to mklappasullivan@mmsd.com.  
  • Send written comments to Attention: Ms. Micki Klappa-Sullivan, Director of Water Quality Protection, 260 W. Seeboth Street, Milwaukee, Wisconsin 53204. Written comments are due before 4:00 p.m. on Thursday, January 22, 2026.
  • Attend the public hearing on January 21, 2026, at 2 pm at MMSD Headquarters (260 W Seeboth St - Milwaukee, WI 53204)

MMSD will include all comments in the rulemaking record.  In response to the comments, MMSD may change the proposed rules before presenting them to the Commission for adoption.  The Commission will consider the comments and the proposed response when deciding whether to adopt the proposed rules.
